2. OBJECT AND SCOPE OF APPLICATION

These General Conditions of Contract and Use apply to visitors to the www.ourivesariacentral.pt website and to any transactions of a commercial nature carried out through the virtual shop.

Browsing the site, as well as purchasing any product, implies the acceptance of these General Conditions of Contract and Use by the User and the Customer.

OURIVESARIACENTRAL reserves the right to change these conditions of use and contracting without notice, any changes being published on the site  www.ourivesariacentral.pt.

 

3. INFORMATION ABOUT CONTENTS

The site www.ourivesariacentral.pt is intended for private use only. The reproduction, transfer, distribution or storage of the contents of the site www.ourivesariacentral.pt without prior written permission is prohibited for purposes other than strictly personal use.

OURIVESARIACENTRAL reserves the right to modify at any time the information and commercial offer presented on: products, prices, promotions, terms and services.

It is expressly forbidden to introduce links from our site for commercial purposes without prior consent of OURIVESARIACENTRAL. Similarly, the use of the domain ourivesariacentral.pt for abusive purposes and without prior authorisation may be subject to legal action by OURIVESARIACENTRAL. In the event that you find links to other sites that allow you to access www.ourivesariacentral.pt, we inform you that OURVESARIACENTRAL has no responsibility either for the origin of the page or the content included therein.

Despite the efforts of OURIVESARIACENTRAL, some products may appear with an incorrect price, so we check the prices whenever we process orders. If the price of the product is lower than the advertised price, we will return the difference. If the price is higher, we will present a new contract proposal with the price duly rectified, waiting for the confirmation or cancellation of the order.

We make every effort to ensure that the information presented is free of typographical errors and whenever these occur, we will proceed as soon as possible to the respective correction. In case the information presented does not correspond to the product's characteristics, the Customer is entitled to rescind the sale and purchase contract under the applicable legal terms.

The photographs presented on the website are merely illustrative.

Prices and product specifications are subject to change without prior notice.

All promotional campaigns have limited stock and are exclusive to online sales. In case of unavailability of the product and/or stock rupture, you will be informed of the partial or total cancellation of your order with the right to reimbursement of the amount paid.

All contractual information is written in Portuguese, as well as the information of the articles, communications by email and formalization of the sale.

 

4. RESPONSIBILITIES

All products sold at OURIVESARIACENTRAL are in accordance with Portuguese law. The articles with precious metal are duly marked, in compliance with RJOC (Judicial Regime of Goldsmithery and Metalwork). The Customer may, in case of doubt about the authenticity of the hallmarks, resort to the services of the Assay Offices for verification purposes.

OURIVESARIACENTRAL declines any responsibility in case of violation of the legislation of the country where the order is delivered. It is up to the Customer to check with the local authorities the conditions of import or use of the products he/she wishes to order. The Customer must comply with the general conditions of sale of the products and OURIVESARIACENTRAL is not responsible for the use that is made of them.

OURIVESARIACENTRAL is not responsible for damages resulting from interference, interruptions, computer viruses, malfunctions or disconnections of the operating system that may temporarily prevent access, navigation or the provision of services to Users.

 

5. OBLIGATIONS OF CUSTOMERS AND USERS

Sales to minors under the age of 18 are prohibited..

The Customer and the User must comply with these general conditions and respect them, and undertake to fulfil the following obligations

1) It is prohibited to introduce, store or disseminate through the website content that is defamatory, obscene, injurious, xenophobic and/or of any other nature that violates the general principles of law and public order;

2) Keep, and not disclose, your password for entering the site in order to prevent third parties from accessing your account at ourivesasariacentral.pt

3) Not to use false identities;

4) To provide correct personal data and address so that OURIVESARIACENTRAL can process orders properly

5) To fill in the registration forms correctly, providing truthful information.

The Customer is responsible for the veracity of the data communicated to OURIVESARIACENTRAL and undertakes to immediately insert in its Registration Account Goldsmithscentral, any changes to the same.

If you do not provide the required information, you will not be considered a registered Customer.

OURIVESARIACENTRAL declines any responsibility for any delay or impossibility to process the order, namely in the act of delivery, resulting from error or insufficiency of the data communicated by the Customer.

 

6. PLACING AN ORDER ONLINE

To place an order at OURIVESARIACENTRAL, we offer three ways:

On the website, once you have registered, simply enter all the items you wish to buy into the virtual shopping trolley. You should follow all the steps of the purchase so that it is finalised successfully.

Validation of the purchase order assumes that the Customer has taken note of and accepts the General Conditions of Contract and Use of the site www.ourivesariacentral.pt. The data registered by OURIVESARIACENTRAL constitutes proof of the set of transactions undertaken between OURIVESARIACENTRAL and the Customer. It is OURIVESARIACENTRAL's responsibility to archive the electronic document in which the contract is formalised and keep it accessible.

Once you finish your purchase you will receive an automatic email confirming the transaction. If the data is not correct you can immediately ask to change it, or cancel the purchase made.

The payment of your purchases is made through a payment system specially designed for ourivesatiacentral.pt, which ensures increased security and privacy.

 

6. AVAILABILITY OF PRODUCTS

The products in our online catalogue can be physically viewed and supervised by the competent authorities at our headquarters.

OURIVESARIACENTRAL only process an order placed by a customer after confirmation of the respective payment, therefore OURIVESARIACENTRAL cannot guarantee the availability of the articles until the beginning of that processing. The estimated time for shipment is added to the transport time that depends on the carrier and the destination of your order.

OURIVESARIACENTRAL only dispatches on working days. Thus, neither weekends nor holidays are counted for estimated delivery of orders.

The average delivery time for products purchased in OURIVESARIACENTRAL is 1 week for deliveries in Portugal and 10 working days for deliveries in the European Union. Personalised items such as wedding rings in Gold or Silver, have an average delivery time of 3 weeks. Delivery times are indicative and therefore to be considered valid when there are no physical or structural impediments (for example: incorrect addresses or force majeure mishaps).

In any case, the estimated delivery dates are merely indicative. If any ordered good is not in stock, OURIVESARIACENTRAL may choose to:

1- contact the supplier inquiring about the possibility of replacement of the missing article, contacting the customer if the delivery time or the price of the article changes being that the order will only proceed after consent given by the customer; or

2- cancel the order reimbursing the customer of all amounts paid.

Any delay verified in the expedition of articles, in relation to the presented estimate dates, does not give the right to indemnity.

Each expedition is accompanied by the following documents:

- Invoice.

The Customer has the right, on receipt of his order, to open the packaging to check that the product is in accordance with what was ordered and that it has no external defects.

OURIVESARIACENTRAL will be obliged to refuse any request for reimbursement or replacement (right of withdrawal) for products presenting external defects that have been accepted by our Customers at the time of delivery. The right of retraction remains valid for cases of technical problems that are detected by the Customer after delivery and according to the terms foreseen by law.

How to proceed upon receipt of the order:

1. Check that the package is in perfect condition.

2. Open the package and ask the courier to wait for verification (this is the Customer's right).

3. Check that the product conforms to the order placed and that it has no visible defects. If everything is in conformity, accept the delivery.

4. If there is any non-compliance, i.e. an error in the product ordered or a visible defect, you must refuse delivery.

5. Return the packaging and all its contents to the courier (carrier).

6. Send an email in the following 24 hours indicating the problem to the Customer Service to the emailinfo@ourivesariacentral.pt

 

7. SHIPPING COSTS

Shipping costs for Continental Portugal, Islands and International

You will be presented in the "checkout" different options, with the indication of their costs, for the shipment of orders depending on their destination.

All customs and excise expenses that may exist will be paid by the customer with the competent services.

If the Customer wishes and informs us, he may also choose to pick up the order at our physical shop at no cost.

 

8. CANCELLATIONS, EXCHANGES AND RETURNS

Applicable to purchases made at www.ourivesariacentral.pt.

From receipt of the order by the Customer, he may exercise his right of free withdrawal under the terms legally provided for and indicated below.

The non-payment of the order within 5 (five) days following the date on which it was made implies its automatic cancellation.

Under the provisions of Law 7/2004 of January 7 on e-commerce, OURIVESARIACENTRAL reserves the right to unilaterally cancel the order whenever there is a programming error, malfunction of OURIVESARIACENTRAL computers or if the contractual proposal arrives deformed at its destination and the error affects an essential element of the contract.

CANCELLATION OF ORDERS WITH CREDIT CARD:

Within the scope of its Customer Satisfaction Policy, and under the applicable legal terms, OURIVESARIA allows the exchange of items, within a period of 8 days from the date of receipt by the Customer, without payment of compensation and without the need to indicate the reason.

To do this, the Customer must communicate his intention in writing via email to apoiocliente@ourivesariacentral.pt. Items must be returned within 8 days of receipt accompanied by the original invoice (article 6 of DL 143/2001, of 26 April, as amended by DL 82/2008, of 20 May).

The return and exchange of articles must respect the following conditions:

•Return of the articles in good condition, with complete original packaging and accompanied by the respective invoice;

•Exchanges of personalised articles according to the Client's specifications are not accepted.

The Customer is responsible for the correct packaging of the products to be returned, as well as for the costs inherent to its expedition.

All items will be checked upon arrival at our service and will only be accepted for exchange or return those that respect the conditions for return.

OURIVESARIACENTRAL reserves the right not to accept articles that do not meet these conditions.

 

8. GUARANTEE OF CONSUMER GOODS AND AFTER-SALES ASSISTANCE

If the product purchased is defective, please notify  info@ourivesariacentral.pt . The costs of return or collection of articles will be borne by OURIVESARIACENTRAL.

Upon receipt of the article at the premises of OURIVESARIACENTRAL we will make the technical verification and if we find any lack of conformity, the article will be replaced. In this case, we will replace the item and send it back to you at no additional cost.

If the technical verification detects signs of misuse, and/or any problem that may have caused the alteration of the article that is attributable to the user (e.g.: fall, etc.) you will be contacted to let us know if you want to proceed with the repair of the equipment. The costs are not covered by OURIVESARIACENTRAL.

 

9. PAYMENT METHODS

Methods of payment

Payment must be made on the date of order, by one of the means indicated below:

- Bank Transfer;

- Multibanco reference;

- PayPal;

- Visa or MasterCard;

- Santander Consumer Finance

The payment must be made after the order is placed, otherwise it will be cancelled.

Payments by bank transfer should be made to IBAN: PT50 0035 0222 00087896 400 59 - BIC CGDIPTPL of Caixa Geral de Depósitos. To speed up the order delivery process you can send us proof of the transfer to the Customer Support Service (email:  info@ourivesariacentral.pt).

 

10. APPLICABLE LEGISLATION

All purchases made on the site www.ourivesariacentral.pt are subject to Portuguese law. Any conflict or divergence of interpretation of the General Conditions of Contract and Use will be submitted to the competent Portuguese Court.

Should our client be located outside mainland Portugal, we inform that any judicial process must be referred to the Portuguese Courts.
